MINUTES OF A SPECIAL MEETING
CITY COUNCIL OF THE CITY OF COUNTRYSIDE, ILLINOIS
HELD IN THE COUNCIL CHAMBERS ON THURSDAY, NOVEMBER 4, 2004

1. After the Pledge of Allegiance to the Flag, Mayor LeGant called the meeting to order at 7:30 p.m. City Clerk Herberts called the Roll which was as follows:

CONSIDER SPECIAL USES RE: ADVANTA FINANCIAL, INC.

Mayor LeGant stated that the purpose of tonight’s Special Meeting is to consider rescinding a previously approved ordinance, re-approving a map amendment and approving special uses regarding Advanta Financial, Inc., proposal for 6510 Joliet Road.

Attorney Erik Peck stated that on September 8, 2004, City Council passed Ordinance 04-35-O which granted a re-zoning as well as three special uses to the property at 6510 Joliet Road. After passing that ordinance, several residents became concerned with the effect the project would have on their residences and asked the City to reconsider the Ordinance. City Council advised that if residents and the developer could reach an agreement on this issue, the City would consider rescinding the original ordinance and entering a new ordinance, which would more adequately protect the residents’ interests.

The revised ordinance will rescind the original ordinance and enact a new ordinance with additional provisions regarding development of the structure and operation of the facilities. Three attorneys have worked on the revised ordinance. Attorney Phil Fornaro represents the property owner. Attorney Mark Daniel, Rathje & Woodward of Wheaton, IL represents the area residents along Dawn Avenue — Joe Tybor, Joel Daly, David Beals, Frank Strama, Alan & Mary Urban, Ricky Vill and Rex Speedro. Attorney Steve Rakich represents the developer, Advanta Financial. Jimmy Rodi from Expert Automotive is also present. The attorneys stated that all the parties have worked very hard at reaching an agreement in this matter.

Additional restrictions have been added to the original ordinance making it a comprehensive agreement by all parties. Mayor LeGant stated that the agreement is 19 pages in length and asked whether any residents present have questions. Mr. Daniel stated that residents acknowledge the length to which the owner and developer went in coming to an agreement. Storm water issues were a concern but they have been addressed. Additional exhibits marked for identification this evening, will be attached to the ordinance; those documents have been viewed by all parties.

Mayor LeGant mentioned some of the highlights in the revised ordinance, which include storm water and drainage, site design and usage including traffic circulation. Developers have agreed to not include businesses such as currency exchanges, payday loan operations, antenna satellite or tower usage, and household appliance sales and repairs. Limited hours of operation, will not include any 24-hour services. Delivery hours, refuse and waste hauling are reasonable; garbage pick-up is limited to 8am-4pm on weekdays, no garbage pick-up on weekends except for emergencies. Noise levels will be reduced; drive-thru speaker microphone system will be located as designated in Exhibit 10. Bay doors for lube and/or muffler operation shall remain closed at all times except for entering or exiting vehicles. Lighting will be modified; no overnight parking of vehicles permitted at building exterior. No outdoor storage of parts, supplies or equipment, or waste materials. Several exhibits are attached to the ordinance.

Joe Tybor stated that the owners/developers were very cooperative in all respects. Mr. Angelillo is concerned with enforcing the ordinance once it has been adopted. Ald. Krzeminski moved to rescind Ordinance 04-35-O, seconded by Ald. Fajdich and carried unanimously by Roll Call vote.

Ald. Krzeminski moved to adopt the Ordinance to re-zone the property commonly known as 6510 Joliet Road from R-1 to B-1 and to approve a special use to permit the operation of an oil lube facility, a muffler repair facility and a drive-thru facility all in substantial compliance with the proposed ordinance presented to this City Council by the residents, developer and property owner, seconded by Ald. Smetana and carried unanimously by Roll Call vote.

Clerk Herberts declared that this will be known as ORDINANCE 04-41-O.

ADJOURNMENT

There being no further business to discuss, Ald. Krzeminski moved to adjourn the meeting, seconded by Ald. Conrad and carried by unanimous voice vote.

Mayor LeGant declared the meeting adjourned at 8:25 p.m.
