APPROVAL OF MEETING MINUTES
The minutes of the Regular Meeting of September 01, 2015 were previously distributed to the Board Members. Chairman Fullmer asked if there were any corrections to be made to said minutes. There were none.
A motion was made by Mr. Gonzalez, seconded by Ms. Grotzke to APPROVE the meeting minutes of the Regular Meeting of September 01, 2015 as presented. The motion carried by the following vote:

CHAIRMAN’S COMMENTS
Chairman Fullmer stated the Rules of Proceeding for the hearing before the Plan Commission – Zoning Board of Appeals will follow a strict order of presentation. A sign-in sheet for interested persons addressing the Board is located at the podium. This hearing is being recorded. Please silence all cell phones and pagers.
ACTION ITEMS
1. Public Hearing Case# 18174_SU Text Amendment to Ordinance No. 03-03-O: A public hearing in The Chicago Tribune to amend Special Use Ordinance No. 03-03-O which granted a Special Use Permit and Exceptions to the Countryside Plaza P.U.D. (Home Depot) to be amended to permit the rental of Penske Moving Trucks within the Home Depot.
a. Mr. Lube moved to open the Public Hearing in this matter, seconded by Ms. Grotzke and carried by unanimous voice vote. Ms. Clarke stated The Countryside Plaza was one of the first large shopping centers built in the City. Since its construction in 1976 as a Planned Unit Development, there have been several big box stores that have come and gone (Venture, Kmart, Builder Square). Home Depot came to the Shopping center in 2003 and requested modifications to the original Planned Unit Development Ordinance. One of their requests was to grant a special use permit for the maintenance of a truck and trailer rental program. Home Depot would like to expand their request to incorporate the rental of Penske Moving trucks which requires an amendment to their Ordinance 03-03-O. Staff is recommending approval of the Penske Truck rental program with conditions. The conditions are as follows: 1. The parking stalls shall be marked with signs designating the location of the Penske Trucks to ensure they stay within the designated area; 2. The number of vehicles will be limited to 14; 3. No semi-trucks or tractor trailer type vehicles will be allowed; 4. All vehicles must be in good working condition and the exterior is maintained; 5. The approval will be for Penske Truck only. If Penske Truck rental were to terminate their lease and a different company wants to locate at Home Depot, they will need to amend the Special Use Ordinance; 6. Require the installation of 10 bike racks on the Home Depot site within 6 months of approval of the Special Use Ordinance. Staff and Home Depot are to work on an agreeable site plan for the location of the bike racks.
b. Mr. Lube agrees with staff’s recommendation with the exception of 14 vehicles.
c. Marisa Kolman with Greenberg Farrow 21 South Evergreen Avenue, Suite 200, Arlington Heights, IL 60005 introduced herself as the site development coordinator representing Home Depot. Marisa clarified that the request is for 14 parking stalls not 14 vehicles. Currently Home Depot is getting the same approval at the Niles, IL Store. The conditions that staff is requesting is similar to what they will be doing at the Niles store. The Home Depot would be requesting to have 3-4 vehicles on the site. The Niles store approved 24 stalls with a maximum of 14 vehicles.
d. Mr. Gutierrez noted that the use of landscape islands on either side of the parking area should be incorporates as a way to provide more landscaping and to better identify the area for the trucks to be parked. Mr. Gonzalez agreed with requirement for landscaping islands.
A motion was made by Ms. Grotzke, seconded by Mr. Lube to concur with staff’s recommendation with the following: The site will be restricted to 14 parking stalls and 2 landscape islands will be installed at either end of the parking area. The motion carried by the following vote:

2. Public Hearing Case# 2015-TA Chapter 13: Regulation of Wireless Telecommunications Towers and Antennas- A public hearing published in The Chicago Tribune to amend the Zoning Code Chapter 13 to permit by Special Use Antennas in the business district.
a. Mr. Anderson moved to open the Public Hearing in this matter, seconded by Mr. Bednar and carried by unanimous voice vote. Ms. Clarke stated, In 2001, the City amended its Zoning Code to create Chapter 13 which regulates wireless Telecommunications. In October of 2015, staff was approached by Mike Howley who represented T-Mobile. T-Mobile was requesting to locate antennas on top of the Holiday Inn Hotel at 6201 Joliet Road. At that time, Staff advised the applicant that Antennas were only permitted on City owned property or as a special use in the M-1 and M-2 Districts only. The Holiday Inn Property is Zoned B-1 and therefore antennas are prohibited. Mr. Howley approached the Plan Commission in July of 2015 to further discuss the proposal and request for the City to consider a text amendment. In August, the attorney for the City stated that he had researched the cellular antenna request brought up last month. There is no definite requirement for the City to make such accommodations. He advised that the City could require a special use to control the location. The City cannot be compelled to do anything but it may be in the City’s best interest to consider it. Staff has provided proposed language which would allow an antenna attached to a building as a special use within the B-1 Retail Zoning District.
b. Mr. Lube is concerned about the number of wall mounted antennas that could be installed and their height. Many of the commissioners concurred.
A motion was made by Mr. Gonzalez, seconded by Mr. Gonzalez to Recommend the proposed text amendment with the change that antennas on top of roofs would only be allowed in the Business District and wall mounted or bracketed antennas on a building would not be allowed. The motion carried by the following vote:

3. Continued Public Hearing Case # 2015-1 – TA – Section 10-2-13: Fences- A public hearing published in The Doings to amend the City of Countryside Zoning Code regulating fences.
a. Mr. Gonzalez moved to open the Public Hearing in this matter, seconded by Mr. Lube and carried by unanimous voice vote. Ms. Clarke stated, At the September 1st Plan Commission meeting, staff was directed to include more language to the definition of the open fence. Staff is suggesting to define an open fence as The term “open-style fence” shall refer to a fence design that has a method of construction and pattern of materials leaving the plane of the fence a minimum of 50 percent open with a minimum 2.5 open space between each vertical member as measured continuously in four-foot intervals along its length. When standing perpendicular to the fence, one should be able to see visibly through it. With the inclusion of 2.5 space between each vertical, this will ensure the intent of the open style fence regardless of how wide the solid portion of the fence is.
A motion was made by Mr. Gonzalez, seconded by Mr. Lube to recommend staff’s recommendation to amend the the fence code as shown in Exhibit A. The motion carried by the following vote:

4. Continued Public Hearing Case # 2015-2 – TA – Section 10-10-3: Off-Street Parking – A public hearing published in The Doings to amend the City of Countryside Zoning Code regulating Off-street Parking.
a. Mr. Bednar moved to open the Public Hearing in this matter, seconded by Mr. Gutierrez and carried by unanimous voice vote. Ms. Clarke stated, at the September 1st meeting, staff was directed to rewrite language to permit recreational trailers so long as they are screened, and to prohibit them from being used for commercial purposes. Staff is presenting the original report which made these trailers permitted as a recreational vehicle and limited the size. Added language was placed in to list the utility trailers as prohibited for commercial use in residential districts.
b. Board members discussed the pros and cons of both approaches – Mr. Lube was concerned about the allowable size of the trailers being too large. After discussion with the rest of the members it was discussed that a more appropriate size would be 7 feet in height, 12 feet in length, or 4,000 pounds in gross weight.
A motion was made by Mr. Gonzalez, seconded by Mr. Kehr to RECOMMEND APPROVAL OF THE OFF-STREET PARKING TEXT AMENDMENT AS SHOWN IN EXHIBIT A WITH THE CHANGE THAT THE SIZE OF A UTILITY TRAILER CANNOT EXCEED 7 FEET IN HEIGHT, 12 FEET IN LENGTH OR 4,000 POUNDS IN GROSS WEIGHT. The motion carried by the following vote:

Ms. Clarke stated that next month there will be a public hearing for Chipotle at 5801 S. LaGrange Road to amend their special use ordinance. They are changing the approved ground sign to keep the existing pole sign. Ms. Clarke stated that she would not be present at the November meeting but Steve Tisinai would be there in her absence. Also a reminder that the special Plan Commission training meeting will be held on Tuesday, November 17th at 7pm.
